AirwayAware — the app and the website

These terms are an agreement between you and Kedar Bakshi ("we", "us") governing your use of the AirwayAware app. By downloading or using the app you accept them. If you do not accept them, please do not use the app.
Read this part first
AirwayAware is educational. It does not diagnose anything.
The questionnaire, the score, the videos and the exercises are here to help you understand your own breathing and to help you have a better conversation with a clinician. They are not a medical examination, not a diagnosis, and not a treatment plan.
A low score does not mean you are healthy. A high score does not mean you have sleep apnoea. Only a qualified clinician, with a proper examination and where appropriate a sleep study, can tell you that.
The same is true of the night recording, the Night Player and the night report. They show what one phone microphone and one consumer finger pulse oximeter measured in your own bed. They are not a sleep study, not a medical test and not a diagnosis.
If you already use CPAP or any other prescribed treatment, do not stop it, reduce it or change it because of anything in this app. Talk to the doctor who prescribed it.
Seek medical attention promptly if you have severe daytime sleepiness, fall asleep while driving, wake gasping or choking, or have chest pain, palpitations or breathlessness.
Who may use the app
AirwayAware is intended primarily for adults. A person under 18 should use it only with the involvement and consent of a parent or guardian. The app is not directed to children under 13. A parent or guardian may use the app to learn about a child's breathing, but the app is not designed to be handed to a child to use alone.
The exercises and the breathing practice
The breathing and myofunctional exercises in the app are gentle by design. There are no forceful breathwork exercises. The breathing practice (from version 1.1) guides slow, comfortable breathing and offers optional short, gentle breath pauses, which show a safety card before the first use. Even so:
- Stop immediately if anything causes pain, dizziness, light-headedness, unusual breathlessness or distress, and breathe normally.
- If you have a heart, lung or other medical condition, are pregnant, or have ever fainted, ask your doctor before practising breath pauses.
- With an oximeter connected, the app stops a breath pause by itself if oxygen or pulse moves too far. That guard is a help, not a medical safety device, and it does not work without an oximeter.
- Do not do the exercises while driving or operating machinery.
- If you are pregnant, or have a heart, lung, neurological or jaw condition, ask your doctor before starting.
- Follow the instructions provided and do not force a movement or breathing pattern.
The night audio tracks
Some content in AirwayAware is audio intended to be listened to at night, as a way of settling before sleep. Certain tracks use binaural beats — two slightly different tones, one to each ear.
Before you listen
- Headphones or earphones are required. Binaural beats depend on a different tone reaching each ear. Played through a speaker the effect does not occur at all.
- These tracks are intended to make you drowsy. Never listen while driving, cycling, operating machinery, or doing anything else that needs your attention. Listen only where it is safe to fall asleep.
- If you have epilepsy, a seizure disorder, or any history of seizures, do not use these tracks without asking your doctor first. Rhythmic audio stimulation is generally avoided in these conditions.
- Not intended for use during pregnancy. If you are pregnant, please do not use the night audio tracks.
- Not intended for children.
- Set the volume to a comfortable, low level before you start. Stop if you feel dizzy, nauseous, anxious, or unwell in any way.
- The night audio is for relaxation and winding down. It is not a treatment for sleep apnoea or for any other condition.
Night recording, pulse oximeter, Night Player and night report
From version 1.1 you can record a night with your phone beside the bed and, if you wish, connect your own Bluetooth finger pulse oximeter. In the morning the app shows the night in the Night Player and in a written report, which you can share as a PDF.
- For your own awareness. The recording, the Night Player, the report and the PDF are not a sleep study and not a medical test. They do not diagnose sleep apnoea or any other condition, and they do not measure sleep stages. AirwayAware is not a medical device.
- Readings can be wrong or missing. Movement, a loose or cold finger, nail polish, a weak battery, a Bluetooth drop-out or a phone placed far from the bed can all affect them. Do not use the app to monitor a medical condition, to decide on a treatment, or in an emergency.
- Keep your treatment. Do not stop or change CPAP, an oral appliance, a medicine or any other prescribed treatment because of anything the night report shows. Talk to the doctor who prescribed it.
- Show it to a professional. The report and its PDF are made so that you can show them to a qualified doctor or dentist, who will read them together with your history and examination.
- Other people. The microphone may record anyone sleeping in the room. Tell them before you record, and follow the rules on recording where you live.
- Your oximeter. Pulse oximeters are made and sold by other companies. We do not make, sell or guarantee them.
Subscription
Some content in AirwayAware is free. The rest requires an auto-renewing subscription. Some content, such as Dr. Bakshi's lecture, has free parts (for example the first chapters) and parts for subscribers only.
AirwayAware is available in the App Store territories Apple makes it available in. Our base prices are set in United States dollars, and Apple converts them into the local price for every other territory using its own price-point system. Two examples, current as of the date at the top of this page:

The price Apple shows you in the purchase sheet at the moment you subscribe is the price that applies to you. It will be in your own currency and may differ from both examples above. Prices may change in accordance with Apple's rules. Applicable taxes may be included or added as required by your territory.
The following terms apply to auto-renewing subscriptions:
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically unless auto-renew is switched off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period, at the price shown by Apple for the applicable subscription.
- You can manage or cancel your subscription at any time in your Apple Account settings: Settings → your name → Subscriptions.
- Cancelling stops the next renewal. It does not shorten the period you have already paid for — your access continues until that period ends.
How subscriptions are handled, and who is involved
Two third parties are involved in a subscription, and it is worth being clear about what each one does.
- Apple takes the payment. Your payment card details, billing address and Apple Account credentials go to Apple. They never reach us and never reach the app.
- RevenueCat, Inc. is the service we use to know whether your subscription is currently active, and to let you restore a purchase on a new device. The app asks RevenueCat "does this person have access?" and acts on the answer.
RevenueCat receives an app-generated identifier that is not your name, your email or your Apple Account, together with purchase and subscription status and basic technical information such as device type, country and IP address. RevenueCat also provides us with aggregate subscription and revenue reporting.
We do not operate a server that stores your personal data. AirwayAware has no user account, no login, and no database of ours holding your questionnaire answers, your Airway Score, your score history, your practice history or your night recordings. Those stay in the app's storage on your own device. (On Android only, if you choose to connect the app to your own clinic, some of it goes to that clinic, as our Privacy Policy explains.)

Refunds
Purchases are made through the App Store, so refunds are handled by Apple, not by us. Request one at reportaproblem.apple.com. If something in the app is broken or not as described, write to us first at kedarbakshi@gmail.com — we would rather fix it.
What you may and may not do
You may use the app for your own personal, non-commercial use, and clinicians may use it with their own patients for educational purposes.
You may not:
- Copy, download, re-record, re-upload or redistribute the videos, articles or illustrations
- Use the content to train a machine learning model without our written permission
- Resell access, or share a subscription account with people outside your household
- Reverse engineer, decompile or tamper with the app except where applicable law expressly allows it
- Present the app's educational material as a diagnosis or personal treatment plan for another person
If you write to us
This version of AirwayAware has no message form inside the app. If you want to reach us, you email us at kedarbakshi@gmail.com. If you do:
- There is no private consultation. We cannot assess, advise on or manage an individual's condition by email, and nothing we write creates a doctor–patient relationship.
- Anything we reply is general education, not personal medical advice.
- We may answer a question of general interest by publishing it, edited and with identifying details removed, inside AirwayAware or in our educational material. If you would rather we did not, say so in your email and we will not.
- Answering is at our discretion and no reply is promised or owed.
- Please do not email medical records, photographs, scans, test results, addresses, phone numbers, identifying details of other people, or anything else confidential. We do not need them and we would rather not receive them.
Intellectual property
The content and materials in AirwayAware — including videos, narration, articles, illustrations, the questionnaire and the scoring method — are owned by us, licensed to us, or otherwise used with appropriate rights or permission. Using the app does not transfer ownership of those materials to you.
Availability and changes
We may add, change or remove content, and we may update or discontinue the app. The app needs an internet connection to fetch new content, though previously downloaded content remains available offline.
Liability
The app is provided "as is". To the fullest extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of it, or from any decision you make based on it. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.
Nothing in these terms limits any liability that cannot lawfully be limited, including for death or personal injury caused by negligence.
Apple
Your use of AirwayAware on Apple platforms is also subject to Apple's Standard Licensed Application End User License Agreement (EULA). These Terms of Use supplement that agreement and do not replace rights or obligations that cannot lawfully be excluded.
Apple is not a party to these Terms of Use and has no responsibility for the app or its content. Apple has no obligation to provide support for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you where applicable.
Ending your access
You may stop using the app at any time by deleting it. We may suspend access if these terms are seriously or repeatedly breached.
Governing law
These terms are governed by the laws of India. Subject to any rights that cannot legally be excluded in your country of residence, disputes are subject to the courts of Mumbai, Maharashtra.
The website (airwayaware.app)
These terms also cover the AirwayAware website and web app. Everything above about education, not diagnosis, the exercises, the breathing practice, the night tracks and the oximeter applies there in the same way.
- The free parts of the website are free to read and use.
- The members' parts open only for someone who already holds an AirwayAware subscription bought in the app, or who has a personal link from their own clinic. There is no separate purchase on the website and no extra fee.
- In the browser, the breathing practice can use a Bluetooth oximeter where the browser supports it. Its guard is a help, not a medical safety device.
- What you do on the website stays in your own browser. Clearing the browser's data for this site removes it, and we cannot restore it.
Changes to these terms
If these terms change we will update the date at the top of this page and announce material changes inside the app.
